Liveflash.co.uk, Liveflash.net ("Liveflash") is a web publishing service and hosting service (the "Service"). You will be responsible for all activities occurring under your username and for keeping your password secure. You have the ability, as you register, to choose your username. We advise that you keep the name appropriate. With this user account you agree to never give your password to another user, for your protection and for validity reasons.
You remain solely responsible for the text, images and files (the "Content") of your messages, and you agree to indemnify and hold harmless Liveflash and any related website. You agree not to duplicate or copy Content, nor place irrelevant or multiple hyperlinks contravening Liveflash content policy and agree to periodically review the Liveflash content policy to ensure awareness of the most up-to-date version. Liveflash may, in its sole discretion, at any time and for any reason, terminate the Service, terminate this Agreement or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other Content contained in your account.
You agree that you are responsible for your own use of the Service, for any posts you make and for any consequences thereof, which includes but is not limited to the following;
Communications Act 2003
Under Section 127 of this Act, anyone who makes improper use of a public electronic communications network may be guilty of an offence. You must be aware that this includes sending or causing to be sent, a grossly offensive, indecent, obscene, or menacing message: or for the purpose of causing annoyance, inconvenience or needless anxiety, sending or causing to be sent, a false message or persistent use of a public electronic communications network.
Defamation Act 1996
In an action of defamation, the person who is the author or publisher, or who causes the publication of a defamatory statement, may be personally liable. Publication can be as simple as showing a defamatory statement made by one person about another to a third person. You must be aware that an action of defamation can result from an electronic communication or voicemail or a statement posted on the Internet.
Malicious Communications Act 1988
You should note that Section 1 of the Act makes it an offence to send, so as to cause distress or anxiety, any electronic communication which comprises information which is indecent, grossly offensive, a threat or false.
Protection from Harassment Act 1997
Section 2 of this Act makes it an offence for a person to pursue a course of conduct that amounts to harassment of another (and which that person knows or ought to know, amounts to harassment). You should note that abusive emails or other electronic communications might constitute such conduct.
